Mega Dollar Games Terms & Conditions

Welcome to Mega Internet Tournaments, L.L.C. dba Mega Dollar Games. Mega Dollar Games and its partners provide their services to you subject to the following terms and conditions. Failure to comply with all of the following Terms and Conditions will subject you, the player without limitation to forfeiture of prizes you may have won, account suspension and or termination, and criminal and or civil prosecution.

General Information

When you register and/or participate in the tournament game(s) on the Mega Dollar Games Web Site you accept without limitation or qualification, the most current version of these Terms and Conditions, each game's and/or tournament's rules of play and any other applicable rules, guidelines, and Mega Dollar Games policies. Mega Dollar Games may modify these Terms and Conditions at any time. Your continued use of the site following such modifications signifies your acceptance of those modifications. You are responsible for reviewing these Terms and Conditions periodically for any such modifications.

Currency And Times

All amounts stated in the Terms and Conditions are in U.S. dollars and times are based on Eastern Standard Time.

Severability

If any portion of these Terms and Conditions is deemed void or unenforceable, then that provision shall be deemed severable from these Terms and Conditions and shall not affect the validity and enforceability of the remaining provisions.

Eligibility

A person who participates on Mega Dollar Games Web Site is hereafter called "Player". By registering, opening an account, using and reusing such an account, participating in the games and/or tournaments, or accepting any prize, Player represents, warrants, certifies and agrees to all of the following:

Player is at least 18 years of age and is not a resident of one of the restricted US states (if Player resides in Nebraska or Alabama, he/she is at least 19 years of age, and if the Player resides in Mississippi he/she is at least 21 years of age).
US restricted states include Arizona, Connecticut, and Vermont.
Player is assigned to the e-mail address submitted on his/her account registration form.
Player resides in a U.S. state in which participation in the game(s) and/or tournaments(s) offered by Mega Dollar Games is unrestricted by law.
Player resides in a Nation, Republic, Province, Country, or US state in which participation in the game(s) and/or tournament(s) offered by Mega Dollar Games is unrestricted by law. The Player further certifies that he/she meets all the legal qualifications to participate in Mega Dollar Games tournaments under the statutes of his/her governing entities.
Player is not a current or former director, officer, employee (including immediate family members) of Mega Dollar Games, its parent companies, subsidiaries, and affiliates. Nor is the player a person with access to non-public information regarding the operation of any games and/or tournaments offered on the site of Mega Dollar Games. For purposes of this section, immediate family members include parents, siblings, spouses, children, or any other person permanently residing in the same household with such current or former employee, officer, or director.
Player has a valid credit card in his/her name. Player shall not allow any other person or third party, including, without limitation, any minor, to use or reuse Player's account, accept any prize, or participate in any game or tournament. Player accepts that Mega Dollar Games maintains the right to demand additional documentation in order to verify that the Player is the credit card holder in the event of a security check.

Game & Tournament Rules Of Conduct

In order to win prizes, Player must be registered, have a verifiable Social Security number, a valid Driver's License and qualify under the above eligibility statement.
Players must abide by the rules specific for each game and tournament. Once a game or tournament in which a Player has participated in is complete, the Player's results are recorded.
In order to be awarded prizes, winners must acknowledge, fully complete, and return all required documentation within the timeframe as indicated in the Prize Fulfillment Validation and Prize Fulfillment Affidavit of Eligibility section below. In the event the winner does not fulfill these requirements; the winner will forfeit his/her prize(s).
Mega Dollar Games reserves the right to audit the play of all tournaments and games. The results of all tournaments and games, and the award of prizes will be subject to such an audit.
Mega Dollar Games will notify by E-mail a Player who has qualified for a Playoff Tournament with information regarding date, time, entry fees and deadlines for the designated Playoff Tournament. In order for a Player to participate in said Tournament he/she must meet all qualifications, enter and pay the entry fee within the prescribed time and be logged on and ready to play when the Playoff Tournament is scheduled. Failure to do so will result in the player forfeiting his/her right to participate in said Playoff Tournament. A player's eligibility to participate in a designated Playoff Tournament can not be transferred to a different or subsequent Playoff Tournament.
Mega Dollar Games shall have no liability for any winner notification that is lost, intercepted, misplaced, or not received by the correct person for any reason. If a player believes he/she has qualified to participate in a specific Playoff Tournament and has not received notification and details by E-mail or fax from Mega Dollar Games within 12 hours of the qualifying achievement, it is then the Player's responsibility to contact Mega Dollar Games' Player Services Department in order to receive the pertinent Playoff Tournament information.
The Top Three Players in any Mega Dollar Game Playoff Tournament category (i.e. Hearts, Spades, Triviera, etc), in additionto receiving the designated prize money or other prizes, will also be entered into Mega Dollar Games Hall of Fame, and both local and national publicity releases announcing their accomplishment will be issued. In order to give other players the chance to enjoy the similar gratification and awards, Mega Dollar Games Playoff Tournament Winners are ineligible to participate in another Mega Dollar Playoff Tournament in the same category for 12 months. Playoff Tournament winners continue to be eligible to participate and compete to win Ranking Prizes and Playoff Tournaments Prizes in any other Game category offered by Mega Dollar Games and they are eligible to participate and win Ranking Prizes in the same category in which they previously won one of the top three Playoff Tournament Prizes.
All games contained and offered by Mega Dollar Games are for humans, not machines. You as a Player agree to play all Games fairly and in a linear fashion, from beginning to end, one at a time, using a single computer, Internet connection and Web browser window. Playing a single-player Game as a group, either live or virtual, is strictly prohibited and will result in automatic forfeiture of any prize winnings on that game or tournament.
Players are not permitted to play any Game or Tournament with more than one type, version or copy of a browsing application at any one time.
Players will not undertake fraudulent measures to accumulate prizes by intentionally defrauding, reverse engineering, disassembling or decompiling or otherwise tampering with the computer programs and games offered by Mega Dollar Games.
Should a player become aware that a Game contains an error, the Player will refrain from taking any advantage whatsoever of the error.
Any attempt by a Player to participate in any game and/or tournament offered by Mega Dollar Game in violation of any of the Game And Tournament Rules Of Conduct, or otherwise commit fraud with regard to the site, will result in civil and/or criminal prosecution, termination of your account, and forfeiture of all prizes to which you may have otherwise been entitled.

Registration Obligations

In consideration of your use of Mega Dollar Games, you agree to the following:

Provide true, accurate, current and complete information about yourself on the Registration Form.
Maintain and properly update the Registration Form to keep it true, accurate, current and complete.

The Registration Form will be used to award prizes, identify the Player during a game, and to notify the player with pertinent information regarding winnings, tournaments, promotions, etc. If you provide any false, inaccurate, not current or incomplete information, or Mega Dollar Games suspects such, Mega Dollar Games has the right to suspend or terminate your account and until it finishes its investigation, refuse you any and all, current or future use of the Mega Dollar Games site. Furthermore, any prizes you win may be forfeited.

Payment

Payment must be made by a valid credit card that is in the Player’s name. A Player automatically forfeits any prize won if the prize is won on a credit card that is declined or rejected.

Account Security and Passwords

Players will provide Mega Dollar Games his/her e-mail address, use that address as its user name, and select a password during the registration process. The Player is responsible for maintaining the confidentiality of his/her e-mail address/username and password, and is fully responsible for all activities that occur under the Player's e-mail address/username, and password. The Player agrees to immediately notify Mega Dollar Games of any unauthorized use of his/her e-mail address/username, password, or any breach of security. It is also a violation of these Terms and Conditions for any person to solicit or use another Player's e-mail address, username, or password. A Player can not have more than one account with Mega Dollar Games.

Your Account

When you register, you will create a unique online account. This will be referred to as "My Account" from which payment for your game and tournament entry fees will be deducted and into which cash prizes will be deposited. You may play games and enter tournaments as long as you have sufficient funds available in your account to pay the entry fee(s). Your account will expire after 3 years of non-use and/or when terminated by you or Mega Dollar Games. If your account expires due to 3 years of non-use, you forfeit any funds remaining in your account. You may not transfer funds to another player’s account or use another player’s account to play games or participate in playoff tournaments. You may not authorize others to use your account. You may not share or transfer funds, cash prizes, free rounds, or bonus rounds residing in your account.

Customer Spending Limits

Players are limited to charging $300.00 per day and $3,000.00 per calendar month to their accounts.

Cashing Out

A Player may "cash out" any or all balances in his/her account at any time. All monies in the account that the Player has when he/she "cashes out," up to the amount of credit card purchases made by that Player, will first be credited back to the credit card account, and the remaining balance (if any) will be sent out in the form of a check. The check will be mailed by first class or by overnight delivery to the address provided by the Player in the registration process. A Player cannot receive a cash payment from credit card proceeds. "Bonus Dollars" can not be "Cashed Out", and all "Bonus Dollars" in a players account will be forfeited if a player cashes out any or all of his/her unused credit card purchases. Cashing out game and/or tournament winnings will not affect a Player's "Bonus Dollars".

Site Rules

Player agrees and acknowledges that the e-mail address/username he/she selects may be displayed on the Site. Player agrees not to use a user name that is vulgar, offensive, obscene, pornographic, hateful, defamatory or unlawful (including names that infringe the rights of third parties). Player also agrees not to use a user name that impersonates others, including Mega Dollar Games employees or other members. Mega Dollar Games is not responsible for any user-generated content. Mega Dollar Games reserves the right to remove any user-generated content for any reason.

Termination Of Account

Mega Dollar Games reserves the right to terminate a Player’s account without notice at any time for any reason. In addition, Mega Dollar Games, in its sole discretion, may terminate or suspend a Player’s password, user name, account (or any part thereof) or use of the site, and remove and discard any content within the site, for any reason. Mega Dollar Games may also in its sole discretion and at any time modify or discontinue, temporarily or permanently the site, or any part thereof, with or without notice. Further, you agree that Mega Dollar Games shall not be liable to you or any third party for any termination of your access to the site. Player may also terminate his or her account for any reason. Once your account is terminated, you cannot play games or participate in playoff tournaments. In addition a Player cannot assist in enabling a terminated member access to the games using his or her account.

Prize Fulfillment Validation

All game and/or tournament winnings will be automatically credited to your account. To cash out your winnings, you must go to the "Cash Out" page under the "My Account" page and proceed as directed. If you "cash-out" winnings of $600.00 or more, you will receive an immediate email message with a toll free number to call to claim your prize. When you call you will need to be prepared to give Mega Dollar Games your telephone number, social security number and certain other validation information, in order for us to send you a Form 1099, as required by Internal Revenue Service Regulations. Failure to provide Mega Dollar Games any validation information as requested will result in Mega Dollar Games inability to process a "cash out" check for any winnings of $600.00 or more. When you choose to receive any winnings exceeding the amount of your credit card purchases, a check will be sent to you by either 1^st Class Mail at no cost to you, electronically transferred directly to your bank account for a $5.00 fee, or by overnight delivery service, in which case you will be charged $20.00 within the US, or $30.00 if international from the US (all fees will be deducted from the amount you are cashing out).

Prize Fulfillment Affidavit of Eligibility

When applicable, winners must execute and return by mail a fully completed and executed Affidavit of Eligibility, a Liability Release, and where lawful, a Publicity Release (all contained in the Email) within 30 calendar days of the date of notification. Failure to return documents timely, or if prize notification is returned as non-deliverable, may result in forfeiture of the prize. If for any reason you are unable to print the required documents in order to complete them, then you must reply to the Email stating you are unable to print and return the required documents. Mega Dollar Games will then mail or fax the required documents to the Player, and the Player will need to sign and return by mail the fully completed and executed documents to Mega Dollar Games. Failure to do so within 30 calendar days of the date of notification can result in forfeiture of the prize.

Taxes And Other Laws Applicable To The Player

Mega Dollar Games reserves the right to withhold, withdraw, or recover any cash prize or other prize as required by law. The Player understands that violating any rule, regulation, term, or condition herein may be in violation of federal, state, and/or local laws. The Player shall be solely responsible for any such violation and, in addition, as a consequence of any such violation, the Player's access to the site may be terminated.

Each and every time a player "cashes-out" winnings of $600.00 or more, it is taxable according to IRS tax laws. The Player understands that he/she will need to provide Mega Dollar Games its Social Security Number, a copy of the Credit Card used, a valid Drivers License and certain other validation information before Mega Dollar Games, its affiliates, or sponsors can "cash-out" a prize of $600.0 or more. Prizes of $5,000.00 or more will have 28% federal tax withheld and submitted to the IRS on the winner's behalf. Prizes cannot be transferred, substituted, or redeemed for any other prizes. It is the player's sole responsibility to abide by any federal, state, and/or local tax laws that may apply to the Player's receipt of cash and/or other prizes.

The Player understands and acknowledges that he or she is responsible for obeying and is subject to all laws of the state, province, and/or country in which he or she resides and from which he or she accesses the site. You agree the site cannot be held liable if laws applicable to you restrict or prohibit your participation. Mega Dollar Games makes no warranties, implicit or explicit, as to your legal right to participate in any game or tournament offered on the site, nor shall any person affiliated, or claiming affiliation, with the site have the authority to make any such representations or warranties.

Winner Participation

By accepting any prize, where permitted by law, Player grants to Mega Dollar Games, its partners, its licensees, affiliates, subsidiaries and assigns the right to print, publish, broadcast and use, worldwide, by all means and in any media now known or hereafter developed, the winner’s name, portrait, picture, voice, likeness and biographical information as news or information and for advertising and promotional purposes without additional consideration. Unless prohibited by law, Mega Dollar Games may also request winners to appear for presentations or other activities which my include filming, audio, video, electronic or other recordings and/or interviews. Furthermore, by accepting a prize, each winner agrees to release and hold harmless Mega Dollar Games, its licensees, their parents, affiliates, subsidiaries, advertising and promotion agencies and their respective directors, officers, employees, representatives and agents from any and all liability for any injuries, loss or damage of any kind to any person, including death, and property, arising in whole or in part, directly or indirectly, from acceptance, possession, use or misuse of a prize or participation in any game or tournament related activity.

Grounds For Disqualification

Mega Dollar Games reserves the right to disqualify any person it finds, in its sole discretion, to be violating these Terms and Conditions or engaging in any conduct Mega Dollar Games deems to be improper, unfair, or otherwise adverse to the operation of the site or detrimental to other players of the site. Such improper conduct, includes (but is not limited to), falsifying personal information required during Player registration or prize claim, accumulating prizes through methods such as automated computer scripts or any other programming techniques, allowing others to use the Player's personal information for the purposes of accumulating prizes or intentionally trying to defraud, reverse engineer, disassemble or decompile or otherwise tamper with the computer programs on the site. The Player will also be disqualified in the event that any credit card transaction is disputed or charged back by the Player's card issuing bank. The Player agrees that Mega Dollar Games may void any prize that the Player may have won and/or require the return of any prize that the Player may have won as a result of such improper and fraudulent conduct. The Player further acknowledges that the forfeiture of prize(s) and/or return of and prize(s) shall in no way prevent Mega Dollar Games from pursuing other avenues of recourse such as criminal and/or civil proceedings in connection with such conduct. In addition, Mega Dollar Games also reserves the right in its sole discretion, to disqualify any individual who tampers with the game playing process, and to cancel, terminate, modify or suspend any game. Any attempt by a Player to deliberately damage the site or undermine the legitimate operation of any game or tournament shall be considered by Mega Dollar Games a violation of criminal and civil laws. Should such an attempt be done to damage or undermine the site, Mega Dollar Games reserves the right to seek damages from any such player to the fullest extent permitted by law. Mega Dollar Games also reserves the right in its sole discretion not to award prizes with respect to any games or tournaments that produce unintended or erroneous results.

Accuracy

Mega Dollar Games, in providing the services, may refer to and/or rely upon information obtained from third party sources. While Mega Dollar Games uses reasonable efforts to include accurate and up to date information, Mega Dollar Games makes no warranties or representations as to its accuracy. Mega Dollar Games assumes no liability or responsibility for any errors or omissions in the content of the site, whether obtained from third party sources or otherwise.

Mega Dollar Games may provide links to other World Wide Web sites or resources. Mega Dollar Games does not endorse and is not responsible or liable for any content, advertising, products, or other materials on or available from such sites or resources.

Disclaimer Of Warranties

You expressly understand and agree that:

Your use of the service is at your sole risk. The service is provided on an "as is" and "as available" basis. Mega Dollar Games expressly disclaims all warranties of any kind, whether expressed or implied, including, but not limited to the implied warranties of merchantability, fitness for a particular purpose and non-infringement.
Mega Dollar Games makes no warranties that (1) the service will meet your requirements, (2) the service will be uninterrupted, timely, or error-free, (3) the results that may be obtained from the use of the service will be accurate or reliable, (4) the quality of any products, services, information, or other material purchased or obtained by you through the service will meet your expectations, and (5) any errors in the software will be corrected. Mega Dollar Games reserves the right not to award prizes with respect to any games played that produce unintended or erroneous results.
Any material downloaded or otherwise obtained through the use of the Mega Dollar Games site is done at your own discretion and risk. You agree that Mega Dollar Games is not liable for any damage to your personal computer, loss, and/or corruption of data, or any consequential or incidental damages as a result of the use or downloading any material from this site.
No advice or information, whether oral or written, obtained by you from Mega Dollar Games, its agents or representatives or through or from the site shall create any warranty not expressly stated in these Terms and Conditions.
Mega Dollar Games is not responsible for any problems or technical malfunction of any telephone, cable or other communications network or lines, computer on line systems, servers, providers, computer equipment, software, failure of any e-mail or communication to be received by Mega Dollar Games due to technical problems or traffic congestion on the internet or at any web site, or any combination thereof. Mega Dollar Games is not liable in any way if a Player's ISP undergoes disruption, interface or downtime during the users use of the site for any other act beyond Mega Dollar Games reasonable control.

Limitations Of Liability

You expressly understand and agree that your participation in the games and tournaments contained on the site are at your risk. Neither Mega Dollar Games nor any other party involved in creating, producing, or delivering the site is liable for any direct, incidental, special, consequential or exemplary damages, including but not limited to, damages or loss of profits, goodwill, use, data, or other intangible losses (even if Mega Dollar Games has been advised of the possibility of such damages). Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of liability for incidental or consequential damages. Accordingly, some of the above limitations of the Disclaimer Of Warranties and Limitation Of Liabilities may not apply to you. In the event that a court of competent jurisdiction makes a determination that any of the exclusions of warranties or the limitation or exclusion of certain liabilities set forth in these Terms and Conditions are unenforceable, the maximum liability of Mega Dollar Games with respect to the services (whether in tort, strict liability, contract, warranty, or otherwise) will not exceed the aggregate amount you charged to your Mega Dollar Games account in the six-month period preceding the date on which the cause of action arose.

Disputes And Discrepancies

The Player accepts that the decisions of Mega Dollar Games and/or its judging organizations shall be final regarding all aspects of the site, including but not limited to, player eligibility, game play, tournament play, winner selection, and prize and award claims. Should there be a discrepancy between the results on the Player’s computer (i.e. the computer used by the Player to access and use the site), and the results on the Mega Dollar Games server, the results on the Mega Dollar Games server shall take precedence. Notwithstanding anything to the contrary in these Terms and Conditions, in the event of any dispute regarding a game or tournament, the decision of Mega Dollar Games will be final and binding in all matters. The Player understands that Mega Dollar Games has the right to suspend or withdraw any game or tournament in its discretion at any time with or without notice.

In the event of a dispute as to entries submitted by multiple Players having the same email account, the "Authorized account holder" at the time of entry will be deemed the participant of the game or tournament. "Authorized account holder" is defined as the natural person who is assigned to an e-mail address by an Internet access provider, online service provider, or other organization (e.g., business, educational, institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.

Governing Law And Disputes

These Terms and Conditions shall be interpreted, construed, governed and enforced in all respects in accordance with the laws of the State of Oklahoma, without regard to its conflict of laws principles. The Player agrees to submit to personal jurisdiction in Oklahoma and further agrees that any action pursuant to this agreement shall be in a State or Federal court in Tulsa, Oklahoma for the purposes of litigating any such action. If any provision of these Terms and Conditions is invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced.

Miscellaneous

These Terms and Conditions contained herein apply to all games and tournaments hosted by Mega Dollar Games. Together with the rules of each game and tournament, they represent the complete, final and exclusive agreement between Mega Dollar Games and the Player with respect to the subject matter hereof.
